Representative Pretrial and Trial Work

I have helped in these and numerous other matters:

  • Represent bank in breach of contract and fraud suit relating to multi-million dollar sale of bank’s assets. I drafted the motion for summary judgment. The case resulted in settlement.
  • Represent client in partnership dispute. The case resulted in settlement, appropriate dissolution of partnership.
  • Represent utility lines construction general contractor in a multi-million dollar breach of contract claim asserted by utility lines owner during the arbitration process.
  • Advise physician group in defamation suit
  • Represent toy company in breach of contract suit for defective products. The case resulted in settlement.
  • Represent gaming company in breach of contract, fraud, and licensing suit. This case was featured on the front page of the Texas Lawyer in April 2012. It examines the power of an arbitrator to create an appropriate remedy to end a contract dispute. I drafted the court briefs, including the winning brief before the Fifth Circuit. Timegate Studios, Inc. v. Southpeak Interactive, L.L.C., 713 F.3d 797 (5th Cir. 2013)
  • Represent corporate clients in insurance coverage case against Directors’ and Officers’ and Corporate Liability insurance carrier. The case resulted in settlement.
  • Represent client with duty to defend issue; insurance carrier withdrew reservation of rights and provided an unconditional defense
  • Advise financial company regarding employment matters during contract negotiations with Federal contractor
  • Advise health care facility regarding employment policies
  • Represent a commercial landlord in breach of contract and wrongful eviction suit. I drafted the winning summary judgment motion.
  • Represent commercial tenant in lease dispute involving issue of first impression under the Texas Business Organizations Code. I drafted the winning summary judgment motion and the winning brief before the Third Court of Appeals. The Texas Supreme Court denied review in January 2014. MT Falkin Investments, L.L.C. v.   • Represent commercial building owner in insurance coverage dispute.
  • Represent an employment discrimination claimant against Microsoft in Travis County, Texas. The jury awarded $11.6 million to the claimant. I assisted the plaintiff’s trial team with legal research and jury charge preparation.
  • Represent contractor in a multi-million dollar wind energy transmission construction project. I wrote various briefs for the arbitration. The firm who hired me and their contractor client were thrilled with the outcome in arbitration.
  • Represent physician in a contentious non-competition case.
  • Represent employers in cases involving breaches of nondisclosure agreements and non-competition agreements. I wrote responses that defeated motions to dismiss under the Texas Citizens Participation Act asserted by former employees and independent contractors.
  • Represent employees accused of disclosing trade secrets to competitors. I wrote their winning summary judgment motions.
  • Help attorney in malpractice suit represent himself. I wrote the winning summary judgment motion and defended the summary judgment on appeal. 
  • Represent heirs and beneficiaries (individuals and charities) in probate and fiduciary litigation. I have written several winning summary judgment motions on issues such as compliance with will formalities, testamentary capacity, undue influence, revocation, and breach of fiduciary duty.
  • Challenge fees submitted by a large law firm totaling over $2 million. After considering our objections, the court awarded only $160,000. We hope to have the $160,000 fee award reversed altogether on appeal.
